Less than half of UK adults have a will.

The report also found that 44% of UK adults had made a will, with men more likely to have made a will

(50% of men; 39% of women) and more likely to discuss their estate with loved ones (62% of men; 55% of women).

“Why is a will important?..”

When a person dies without leaving a valid will, their property (the estate) must be shared out according to certain rules. These are called the rules of intestacy. A person who dies without leaving a will is called an “intestate person.” Before you receive any funds are access to the deceased persons estate. You have to apply for probate which can take Months or Years and can also costs 1000’s…

Only married or civil partners and some other close relatives can inherit under the rules of intestacy.

It’s happened to my family and it’s horrible. It took nearly a year to be resolved and cost SOO much money.

I feel families SHOULD have access to this knowledge as unfortunately it is something that is needed and something that is extremely important.

A will stops your estate going to Probate and stops any issues.

Just like your Trust is free with your Life Insurance I also think your Will should be free.

Not setting up a will could cost your family THOUSANDS...like it did with mine.

A last will and testament is a legal document that communicates a person’s final wishes pertaining to their assets.

It provides specific instructions about what to do with their possessions. It will indicate whether the deceased leaves them to another person, a group, or wishes to donate them to charity.

The rules of Intestacy

Under the rules of intestacy in England and Wales, if the Deceased has a spouse or civil partner and the estate (in the sole name of the Deceased) is not worth more than £322,000, the spouse or civil partner is entitled to everything. Joint assets pass by survivorship unless specific arrangements over those joint assets have been made.

Statutory Legacy sum

When the estate is worth more than £322,000 and the person who died has children, the children will receive half of the remaining amount over the £322,000 threshold, and the spouse or civil partner is entitled to the other half. For example, if an estate is worth £522,000 (in the sole name of the Deceased), the spouse or civil partner would inherit £422,000 (£322,000 plus £100,000 from half of the remaining estate) and any children would inherit £100,000 split equally between them.

*You will only receive the money AFTER Probate has been granted.. This can take months or years.

Changing Your Will

“What If My Circumstances Change?..”

You will just have to re fill out another will.

Your last will and testament is 

“A legal written document that specifies where and to whom you wish your property and possessions – known as your ‘estate’ – to be distributed in the event of your death.”

Once a new will is created your previous will is Invalid. So by simply making a new will it overwrites your previous Will.

If your circumstances change you will need to re write a new will.
